These Terms of Service govern your use of the Track It website at track-it-sis.vercel.app, operated by Beyond the Hairline LLC together with Chat Chew and Do Empowerment Women Group (CCDEW), a Mississippi nonprofit. Beyond the Hairline LLC is its own legal entity, separate from CCDEW, under which the Service was originally offered. In these Terms, "we" and "us" mean both entities, together with their respective officers, directors, employees, and volunteers. By using the Service, you agree to these Terms.
Track It is an educational self-tracking tool. It is not medical advice, diagnosis, or treatment. Information provided is for general informational and educational purposes only. Always consult a qualified healthcare provider regarding any medical condition, symptom, or treatment. Never disregard professional medical advice or delay seeking it because of something you read on the Service. If you think you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.
You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and have the legal capacity to agree to these Terms.
You agree to provide accurate information when requesting the tracking app. You are responsible for all activity that occurs under your registration on your device.
You agree not to use the Service to violate any law, infringe on the rights of others, transmit harmful code, attempt to gain unauthorized access, interfere with the Service, or use the Service for any commercial purpose without written permission from CCDEW or Beyond the Hairline LLC.
All content on the Service, including the Track It name, Beyond the Hairline name, logos, text, graphics, design, and code, is owned by CCDEW, Beyond the Hairline LLC, or their licensors and protected by copyright and trademark law. You may not copy, reproduce, distribute, or create derivative works without written permission.
Any information you input into the journal remains your property. Your journal entries are saved right here in your browser on this device, so they are ready whenever you come back, and they stay private to whoever uses this device or browser. Because they are not transmitted to CCDEW or Beyond the Hairline LLC, neither entity has access to, control over, or responsibility for your journal entries. Signing out deletes them from the device, so print or export anything you want to keep.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. Neither CCDEW nor Beyond the Hairline LLC warrants that the Service will be error-free or free of harmful components.
To the maximum extent permitted by law, CCDEW, Beyond the Hairline LLC, and their respective officers, directors, employees, volunteers, and affiliates shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of data, loss of profits, or personal injury, arising from your use of the Service. The total aggregate liability of CCDEW and Beyond the Hairline LLC, combined, shall not exceed one hundred US dollars ($100).
You agree to defend, indemnify, and hold harmless Chat Chew and Do Empowerment Women Group (CCDEW), Beyond the Hairline LLC, and their respective officers, directors, employees, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or connected with your use of the Service, any content you enter, or your violation of these Terms or of any applicable law. This obligation survives if you stop using the Service.
CCDEW and Beyond the Hairline LLC reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive.
The Service may contain links to third-party websites or reference third-party services. Neither CCDEW nor Beyond the Hairline LLC endorses or assumes responsibility for any third-party content, products, or services. Your use of third-party websites is at your own risk.
These Terms are governed by the laws of the State of Mississippi, without regard to conflict of laws principles. Any dispute arising from your use of the Service will be resolved under Mississippi law.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service that cannot be resolved informally will be settled by binding arbitration administered by the American Arbitration Association (AAA) under its then-current rules. The arbitration will take place in the State of Mississippi and will be conducted by a single arbitrator. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction. You waive the right to a jury trial and the right to participate in any class action.
For any matter that is not subject to arbitration, or that is brought to compel arbitration or to enforce an arbitration award, you agree that the exclusive venue is the state and federal courts located in Hinds County, Mississippi, and you consent to the personal jurisdiction of those courts.

Neither CCDEW nor Beyond the Hairline LLC shall be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, civil unrest, government action, power failure, or internet or telecommunications failure.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary. The remaining provisions shall remain in full force and effect.
You may not assign or transfer these Terms or your rights under them without prior written consent from CCDEW or Beyond the Hairline LLC. Either entity may assign these Terms at any time without notice.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and CCDEW and Beyond the Hairline LLC regarding the Service and supersede any prior agreements.
CCDEW and Beyond the Hairline LLC may modify these Terms at any time. Changes are effective upon posting with an updated date. Continued use of the Service after changes means you accept the revised Terms.
